Terms and Conditions
Welcome to the Open Beta of StrayCats Breedables™ Cats!
Acceptance of the Terms
The following terms and conditions are between the user and StrayCats Breedables™ concerning the participation and purchase of all StrayCats Breedables™ Cat products. Please READ our terms and conditions before participating in or using our StrayCats Breedables™ Open Beta Cat products. To participate in open beta the user must join the StrayCats Breedables Group in Second Life.®
User can agree to our terms and conditions by actually purchasing/participating in the StrayCats Breedables™ Cats Open beta.
If you do not agree to any of the following terms, please do not use, purchase, or participate otherwise in our StrayCats Breedables™ Open Beta.
Changes to this Agreement
StrayCats Breedables™ may update or change these terms and conditions from time to time and recommends that the user of our services review the Terms and Conditions on a regular basis throughout our Open Beta. User understands and agrees that the continued use of our service after the Terms and Conditions has changed constitutes users acceptance of the new revised Terms.
Description of Open Beta Services
1. StrayCats Breedables™ Open Beta
The user or customer acknowledges that the service being provided by StrayCats Breedables™ is being released as a “Open Beta” which is a public beta service of the new StrayCats Breedables™ breedable cats, and is made available AS IS and AS AVAILABLE basis. This release is for the purpose of providing StrayCats Breedables™ with feedback on the product, testing the quality and usability of the service, and to help cover company expenses (such as for server costs). The cats may occasionally contain errors or inaccuracies that could cause failures, corruption, or loss of data and information from Secondlife usage or other unexpected issues (ex. server outage, termination of service, etc), to which StrayCats Breedables™ is not obligated or responsible to compensate a user for any such disruption in the service.
User acknowledges that this is part of the Open Beta progress. Participant will assume all risks and all costs associated with using our StrayCats Breedables™ Open Beta service, including, without limitation to purchasing our open beta cats, reselling cats, purchasing any and all StrayCats Breedables™ products from the store. Any and all user investments into the StrayCats Breedables™ Open Beta services is strictly the choice and responsibility of the user.
2. Updating Requirements
The user acknowledges that their cats or products will be frequently updated during Open Beta phase, this may or may not cause interruption in the service. During Open Beta there will be announcements requiring all users to update their StrayCats Breedables Cats to the latest versions. StrayCats Breedables™ is not responsible for any user who does not update their cats, updating cats is the responsibility of the owner or customer.
3. Changes in Service
StrayCats Breedables™ reserves the right to modify, suspend or stop the Open Beta service (or any part thereof), either temporarily or permanently, at any time or from time to time, with or without prior notice to the customer. StrayCats Breedables™ will however provide notice of any major changes to the service by posting them on it’s website/ and or via these Terms and Conditions. Participant agrees that StrayCats Breedables™ shall not be liable to the user or any third party for any modification, termination, or interruption of the service.
4. Open Beta to Full Release
Open Beta phase will continue until StrayCats Breedables™ feels the product is clean enough to become a full release, when this occurs, users will be notified through every social media source that StrayCats Breedables™ owns. Customers will keep the cats they had purchased throughout open beta and into full release. User understands that when this occurs, the StrayCats Breedables cats Terms and Conditions could change to accommodate the new full released products, but are still in full effect after Full Release.
As part of using the service, StrayCats Breedables™ will provide the user with the opportunity to submit comments, suggestions, or other feedback regarding use of our open beta cats. User must acknowledge that any and all suggestions or feedback may be considered but not always acted upon.
StrayCats Breedables™ Store Policies
1. No Refunds
Once an item or cat is purchased, there will be no refunds. StrayCats Breedables™ will only be required to give the customer the product that they intended to purchase. StrayCats Breedables™ is not obligated to refund a customer for the following reasons: wrongful purchase, impulse purchasing, disappointed in product, bored of product, not what customer expected, etc.
2. No Exchanges
Once an item or cat is purchased, there will be no exchanges of any items. StrayCats Breedables™ is not obligated to exchange purchases due the following reasons: wrongful purchase, impulse purchasing, disappointed in product, bored of product, not what customer expected, Secondlife sim lag, etc. StrayCats Breedables™ is not responsible for purchasing mistakes as all vendors are labeled with the proper information when browsing for a product. If this should happen to a customer, they would need to re-purchase the proper product they intended to buy before their browsing error. StrayCats Breedables™ cannot and will not exchange a purchase due to the permissions of the object which also make it non-transferable.
3. No Guarantees
When you adopt (purchase) kittens from the StrayCats Breedables™ store(s), you will receive random colorations with each pelt or breed. StrayCats Breedables™ does not guarantee that every kitten will contain specific traits. The chances of something new to each customer is to be found through dedicated breeding, but there’s simply no guarantees to gaining new pelts or traits in every breeding. Finding traits requires breeding what the customer feels are their best matches, as Dominate vs. Submissive genes play a major role in what shows and what does not.
User Care and Responsibilities
1. Record Keeping of Pet
User is responsible for keeping records of the cats they own within the Open Beta phase. StrayCats Breedables™ will do their best to restore any missing cats to their rightful owners, however StrayCats Breedables™ is not obligated or responsible to restore or replace any missing cats if the owner does not keep proper record of their cattery. StrayCats Breedables™ strongly encourages the customer to keep record of their beta cat ID numbers which are located in the description of the cat, under it’s name. To find the number you must edit the cat, go to General tab, locate the number below it’s name.
2. User/Owner Responsibilities
Cats adopted (purchased) from the StrayCats Breedables™ store or secondary market are instantly the responsibility of the owner who has taken them into their care. StrayCats Breedables™ is not responsible to care for, watch, or monitor a users pets due to unexpected trips or time away from Second Life (I.E. out of town, hospitalization, or other RL situations that may occur). While StrayCats Breedables ™ understand some of these situations may be unexpected, it does not make StrayCats Breedables™ responsible for the care or expenses needed for time away from a users virtual pets.
3. Secondary Market
StrayCats Breedables™ permits the use or resale of our virtual cats for the Secondary Market. However, by using, reselling, or breeding StrayCats Breedables there are a few terms to be clarified. If a user plans to breed and sell within the secondary markets, this makes StrayCats Breedables™ not obligated or responsible to handle any and all dealings of a market owner to it’s customer. StrayCats Breedables™ is not responsible for linden transferring of adopted kittens between market owners and their customers (nor responsible or obligated to replace the kitten in question). StrayCats Breedables™ will however take action towards those that have violated the Digital Millennium Copyright Act (DMCA). Owner or user is responsible for their own dealings when trading, selling, or otherwise managing their cats with another person of interest. Should any situations arise between two owners over their cats ( disputes, arguments, disagreements, sniped cats, purchases ), the situation should be handled between those owners to resolve the problem.
StrayCats Breedables™ User Policies
1. StrayCats Breedables™ Customer Support
We will do our best with customer support to help you reach your needs, the fastest way to get some help will be going to the website (http://www.mystraycats.com) and filing at ticket. While not every situation may be handled how a customer may wish, the customer has already agreed to the terms and conditions of participating in the StrayCats Breedables™ Open Beta, which indicates that product is distributed as is or as available to customers. StrayCats Breedables™ has the right to dismiss any and all customers who are rude or ill mannered towards us during any customer service help.Rude behavior includes: bad language, harassment, continued pestering, threats, demands, and overall distasteful behavior. So we ask that everyone be respectful and understanding when dealing with our staff and we will do the same in return.
2. Tampering and Duplication
StrayCats Breedables™ retains the copyrights of our products and their contents. We will eventually need to update our pets as time goes on, this includes adding new features and accessories. StrayCats Breedables™ ask that you do not try and remove the scripts or the product will break itself for being tampered with and will NOT be replaced. If there should be any type of illegal duplication of StrayCats Breedables™ products, any and all items that are functional by the said owner who abused the system will be deleted from their account and we will result to possible legal matters.
3. Exploiting and Cheating
Exploiting is when you do an act that makes you benefit purely from it and abuse it for self gain.
StrayCats Breedables™ take exploiting VERY seriously and will remove all products/cats a customer has worked hard on obtaining due to exploiting the bug, issues, etc. StrayCats Breedables™ has every right to confiscate and WILL confiscate all pets/products owned by the user if we happen to find, or be given documented proof that someone is exploiting our products. Confiscating cats means StrayCats Breedables™ will remove everything owned from the exploiter/persons accused of exploiting without warning. The customer will then have to purchase all new starter kittens if they choose to continue using our services after exploiting. If not banned from all our vendor(s), store(s) or SIM(s). StrayCats Breedables™ log everything within the products database. StrayCats Breedables™ will investigate any SIM/location that we suspect has exploiting behavior. If StrayCats Breedables™ is declined to investigate the SIM/location under suspicion, there will be action taken to stop the exploiter from owning any current pets until there is an explanation received on why we cannot investigate the location. Do understand that exploiting is a serious offense and it will be dealt with in quick action. Consider this the only warning.
4. Banned Accounts and Alt Accounts
StrayCats Breedables™ is NOT responsible for any users Second Life banned accounts or alt accounts. StrayCats Breedables™ cannot help a user account that was/is banned, locked, or otherwise unreachable from Second Life, this is something the user will have to take up with the staff of Second Life; not us. StrayCats Breedables™ is not obligated and will not replace any products to another account due to those reasons that deal with Linden Labs directly. Any and all StrayCats Breedables™ products a user contained on their banned or locked account will not and can not be restored to a users new account. StrayCats Breedables™ has a strict database that is very user reliant, so this is just not possible. User will have to repurchase StrayCats Breedables™ cats/products from the StrayCats Breedables™ store or contact Linden Labs to restore the users account.
5. Digital Millennium Copyright Act (DMCA)
All original designs, textures, scripts, sculpts, and script code content are the intellectual property of StrayCats Breedables™ in Second Life ® and may not be unlawfully used in anyway. Legal action can be taken under the DMCA against a SL resident directly if a user/company is suspected to either have made illegal copies with SL tools (such as copybot), taken/recreated our textures or sculpt work, stolen scripts, or any other illegal activity that could hinder the StrayCats Breedables™ business within Second Life ®. StrayCats Breedables™ will take immediate legal action if any intellectual property is suspected of being used/stolen and will contact Linden Labs on the nature of the violation.

Termination of Imaginimals™ Service
1. Termination by User/Customer/Participant
User may terminate their usage of the StrayCats Breedables™ Open Beta cats services by discontinuing use of the service at any time. StrayCats Breedables ™ is not obligated or responsible to cover the expenses of the user via these terms and conditions if user should choose to terminate the service.
2. Termination by StrayCats Breedables™
StrayCats Breedables™ reserves the right to suspend, terminate, or stop the Open Beta service (or any part thereof) of any specific user/customer, either temporarily or permanently, at any time or from time to time, with or without prior notice to the customer. Termination from StrayCats Breedables™ may occur to any user or customer for or not limited to the following reasons; Tampering, Duplication, Exploiting, Cheating, DMCA violation, Secondary Market abuse, Inability to maintain, Server outage, etc.
